These Terms of Use ("Terms") are an agreement between you and Danish Khan ("we," "us," "our") for the Colourify: Fill Colour app for iPhone and iPad (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. Children and Parents
The App is made for children. If you are a parent or guardian, you accept these Terms on behalf of your child and are responsible for their use of the App, including any purchase. If you are a child, please ask a parent or guardian to read these Terms with you. Purchases, restoring purchases, links that leave the App, sharing and reminders are protected by a grown-up question (a parental gate).
2. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, for personal, non-commercial use, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including Family Sharing where Apple allows it.
3. Free Content and the One-Time Purchase
The App includes a free selection of pictures and features. An optional one-time, non-consumable purchase ("Unlock Everything") unlocks the App's premium picture packs, all brushes, fill styles and background sounds, colouring books, and unlimited drawings of your own, for as long as the App remains available. It is not a subscription and there are no recurring charges.
- Payment is processed by Apple. We never receive your payment details.
- Purchases can be restored on devices using the same Apple ID with "Restore Purchase" in the App's Settings.
- Refunds are handled by Apple under Apple's policies (reportaproblem.apple.com). We cannot issue refunds directly.
- Prices are shown in the App Store before you buy and may change for future purchases.
- We may add, improve or retire content and features over time. We will not remove a feature you have purchased for as long as the App remains available, except where required by law or by Apple.
4. No Advertising
The App contains no advertising and no third-party advertising or analytics services.
5. Your Content
You own the artwork you create in the App. Photos and drawings you import, and everything you create, stay on your device; we have no access to them. Please only import photos you have the right to use, and do not use the App to create or share anything unlawful or harmful. You are responsible for what you choose to save or share outside the App.
6. Acceptable Use
You agree not to:
- Copy, sell, redistribute or publish the App's pictures, sounds or other content outside the App, except for sharing artwork you have coloured for personal, non-commercial purposes
- Reverse engineer, decompile or disassemble the App, except where the law allows
- Circumvent the parental gate, the in-app purchase, or any other protection in the App
- Use the App in any way that breaks the law
7. Intellectual Property
The App, including its design, pictures, colouring templates, sounds and code, belongs to Danish Khan or its licensors and is protected by intellectual property laws. Third-party materials are used under their licences (for example, the Fredoka font under the SIL Open Font License). No rights are transferred to you except the licence in section 2.
8. Healthy Use
We encourage regular breaks from screens and suggest parents supervise young children's device use and volume, especially with headphones. The App has no time limits or streak pressure by design.
9. Disclaimer of Warranties
To the extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that saved progress will never be lost. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.
10. Limitation of Liability
To the maximum extent permitted by law, Danish Khan will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or artwork, arising from your use of, or inability to use, the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App and its in-app purchase in the twelve months before the claim, or USD 10 if you paid nothing. These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
11. Apple
These Terms are between you and Danish Khan only, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, consumer protection or privacy claims, or claims that the App infringes a third party's intellectual property; we, not Apple, are responsible for the investigation, defence and settlement of any such claim. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you.
12. Termination
You may stop using the App and delete it at any time. Your licence ends automatically if you break these Terms.
13. Changes to These Terms
We may update these Terms. The "Effective Date" above shows the latest version, and continued use of the App after an update means you accept it. We will not use changes to take away a purchase you have made.
14. Governing Law and Disputes
These Terms are governed by the laws of the country in which Danish Khan resides, without regard to conflict-of-law rules. If you live elsewhere as a consumer, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts. Before starting any formal claim, please contact us so we can try to resolve the issue informally.
15. General
If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy, are the whole agreement between you and us about the App. Our not enforcing a term is not a waiver of it.
